YOUR RIGHTS AS A CONSUMER

“YOU HAVE THE RIGHT TO USE THE SUPPLIES OF YOUR CHOICE”
US Congress Passed New Legislation in 2002

The Original Equipment Manufacturer (O.E.M) cannot void your printer warranty for using non-OEM cartridges. The brand of supplies you purchase is your decision. You are not required by any machine manufacturer’s warranty to use only its brand. In fact, there are laws preventing manufacturers from doing just that – please take a moment to read this.

Magnuson-Moss Warranty Improvement Act
United States Code Annotated       Title 15 Commerce and Trade
Chapter 50 Consumer Product Warranties 15 Sections 2302

“(c) No warrantor of a consumer product may condition his written or implied warranty of such product on a consumer’s using, in connection with such product, any article or service (other than article or service provided without charge under terms of the warranty) which is identified by brand, trade or corporate name; except that prohibition of this subsection may be waived by the commission if:
1) Warrantor satisfies the Commission that warranted product will function properly only if the article or service so identified is used in connection with warranted product, and
2) Commissions finds that such a waiver is in public’s interest.”

This means that the manufacturer of your printer cannot void your printer’s warranty because you use a cartridge or refill kit manufactured by someone other than the printer manufacturer. This prohibition includes use of compatible cartridges, clip-ons, continuous feeding mechanisms, refill kits, ink, etc.
